The Tiara at the Abbey Special Notices

As a reminder, please review Tiara at the Abbey Covenants, Indenture 23. Recreational Vehicles: “Recreational vehicles such as three and four wheelers, dirt bikes, motorcycles, or any other type, may not be ridden within the boundaries of TIARA at the ABBEY subdivision.” Numerous reports of violations have been reported to Trustees, including these prohibited vehicles being driven on the common grounds as well as the subdivision streets. Refrain from any further violation to avoid indenture violation fines.

Further, as documented by the HOA attorney, “The Declaration of Trust and Protective Covenants of Tiara at the Abbey were recorded with Jefferson County at the inception of the community, giving potential residence notice of those rules that are more restrictive than city ordinance. The restrictions are attached to the land, and they bind all future owners of the land. The restrictive covenants also allow the Trustees to arrange for roads and common areas within the community to be maintained. Though the city of Pevely takes the responsibility of maintaining these roads, their actions do not negate the HOA’s right to enforce all the restrictions within the HOA, including the restriction on ATV usage.”
